Personal Data Protection Law Clarification Text
In this clarification text, the following terms are defined:
Personal Data: Any information relating to an identified or identifiable natural person.
Sensitive Personal Data: Data related to race, ethnic origin, political opinions, philosophical beliefs, religion, sect or other beliefs, clothing, membership in associations, foundations or trade unions, health, sexual life, criminal convictions and security measures, as well as biometric and genetic data.
Personal Data Protection Law (KVKK): The Law No. 6698 on the Protection of Personal Data, which came into force on April 7, 2016.
Data Processor: A natural or legal person who processes personal data on behalf of the data controller based on the authority granted by the data controller.
Data Controller: The natural or legal person who determines the purposes and means of processing personal data, and is responsible for establishing and managing the data recording system.
As Erkan Güner, in my capacity as Data Controller, I would like to inform you regarding our obligations under the KVKK, including the identity of the data controller, examples of processed personal data, purposes of processing personal data, retention period of personal data, transfer of your personal data to third parties and/or abroad, methods and legal grounds for collecting personal data, and your rights granted under the KVKK.
The data controller under KVKK is Erkan Güner, registered with the Istanbul Trade Registry with the number ..., and located at .../Istanbul.
Personal Data Provided by You: Name-surname, date of birth, T.C. identification number, phone number, email address, address, and any other personal data shared through surveys or other channels.
Automatically Collected Personal Data: Personal data collected automatically through search engines, audio and video recording devices, cookies, or other means.
Personal Data Obtained from Other Sources: Updated delivery and address information, account details, purchase and page viewing information shared by social media tools, business partners, suppliers, and other third parties based on your prior consent.
Your personal data is retained in compliance with KVKK and other relevant regulations for the duration required by the purpose of processing. Data will be deleted, destroyed, or anonymized once the reasons for processing cease to exist.
Generally, your personal data is processed based on your explicit consent. However, it may also be processed without consent in accordance with the legal obligations specified in KVKK, such as fulfilling a contract, legal obligations, or protecting legitimate interests. This includes processing personal data for providing products and services ordered online, communication, sales, and marketing activities.
Your personal data may be transferred to third parties and abroad without your explicit consent under the conditions specified in KVKK.
Your personal data may be collected through channels such as application forms, membership and contact forms on our websites, cookies, job application forms, and in accordance with KVKK and other relevant laws.
According to Article 11 of KVKK, you have the right to inquire whether your personal data is processed, request information if it is processed, learn the purpose of processing, know third parties to whom your data is transferred, request correction of incomplete or inaccurate data, and request deletion of your data when the reasons for processing cease to exist. Requests should be submitted in writing.
